Terms of Service
These Terms of Service define the rules, expectations, and boundaries between WebWave Studios and our clients when providing design and development services.
1. Agreement to Terms
By accessing our website at webwavestudios.com or engaging our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.
2. Services Provided
WebWave Studios provides web design and development services, including but not limited to static websites and e-commerce stores for businesses in Trinidad & Tobago and internationally. The specific scope, deliverables, and pricing for each project will be agreed upon in writing prior to commencement.
3. Payments
- A deposit may be required before work begins, as specified in your project agreement.
- Remaining balances are due upon completion and before final delivery of files, access credentials, or ownership transfer.
- All payments must be made via approved payment methods communicated at the time of engagement.
- All fees are non-refundable unless otherwise agreed in writing.
4. Project Scope and Changes
Any changes to the agreed project scope may result in adjusted timelines and additional costs. Clients will be notified of any changes in writing before additional charges are applied.
5. Client Responsibilities
Clients are responsible for:
- Providing all necessary content (text, images, branding assets) in a timely manner
- Reviewing and approving project milestones promptly
- Ensuring all content provided does not infringe upon third-party intellectual property rights
Delays caused by the client may impact project delivery timelines, for which WebWave Studios bears no responsibility.
6. Intellectual Property and Ownership
- The client retains ownership of all original content they provide.
- Upon receipt of full payment, WebWave Studios transfers full rights to the final website design and custom assets developed for the client's project.
- WebWave Studios reserves the right to display completed projects in its portfolio unless otherwise agreed in writing.
7. Delivery Timelines
Estimated delivery timelines will be communicated at the start of each project. In the event of unavoidable delays on our end, the client will be notified promptly with a revised timeline.
8. Warranty and Support
WebWave Studios warrants that all delivered work will be free from defects in workmanship for a period of 30 days following project completion. This warranty does not cover issues arising from client modifications, third-party integrations, or hosting/server problems beyond our control. Support and maintenance services beyond this period are available under separate agreement.
9. Limitation of Liability
WebWave Studios shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability in any matter shall not exceed the total amount paid by the client for the specific project in question.
10. Termination
Either party may terminate a project agreement with written notice. In the event of termination:
- The client will be invoiced for all work completed up to the termination date
- Any deposits paid are non-refundable
- WebWave Studios will deliver all completed work upon receipt of payment for services rendered
11. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This obligation survives the termination or completion of the project.
12. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Trinidad & Tobago. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Trinidad & Tobago.
13. Changes to Terms
WebWave Studios reserves the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the modified terms.
